Privacy Policy. PRIVACY NOTICE PURSUANT TO ART. 13 OF EU REGULATION NO. 679 OF 27 APRIL 2016 The current legislation regarding the processing of personal data, defined in accordance with the provisions contained in EU Regulation 679/2016, contains provisions aimed at ensuring that the processing of personal data is carried out with respect for the rights and fundamental freedoms of natural persons, with particular regard to the right to the protection of personal data.
1 – Definitions. Personal data: any information relating to an identified or identifiable natural person (data subject) that has been entered into the records of the company Art Finance Fund as a result of registration on the website www.artfinancefund.com. Registered user: any natural person, legal entity, body, association, etc., who has completed the registration procedure or the purchase of one or more services on the portal www.artfinancefund.com.
2 – Data Controller. The Data Controller is the company Art Finance Fund, represented by the legal representative pro tempore, VIES BG206007637, based in Sofia 1000 Georgi S. Rakovski str. 96A.
3 – Purpose of processing. In compliance with the obligations of current legislation, we inform you that the Controller processes your personal data for: 1. entering into the contract, fulfilling contractual obligations as well as carrying out all activities necessary or useful for the constant improvement of the service provided. 2. purposes arising from legal obligations, whether national and/or international and/or EU in nature, from provisions issued by competent authorities or supervisory and control bodies. 3. the protection of the rights or legitimate interests of the Controller, including in court or elsewhere in accordance with the principles established by law. Furthermore, with your explicit consent, your personal data will be processed for the following purposes: a) to send information, discounts, and updates regarding the services offered by the portal www.artfinancefund.com. b) to send news and promotions offered by Art Finance Fund's business partners.
4 – Methods of processing and storage. Processing will be carried out in automated and/or manual form, according to the principles of fairness, lawfulness, transparency and in compliance with the provisions of art. 32 of GDPR 2016/679 (Security of processing), by specifically appointed persons and in compliance with the provisions of art. 29 GDPR 2016/679 (Processing under the authority of the controller or processor). Please note that your data will be stored for no longer than is necessary to achieve the purposes for which they were processed. In particular, regarding the management of the existing contractual relationship (free registered user / subscribed user), it is specified that the processing and storage of data will continue until Art Finance Fund receives a request for deletion of the registered user from the website www.artfinancefund.com. We also inform you that, for data processing whose purposes are indicated in points “a” and “b” of the section “purpose of processing”, you can revoke your consent at
any time by acting directly on your personal profile. The above processing may be carried out through traditional contact methods (e.g.: operator phone calls) or automated methods (e.g.: sending emails). It is specified that processing based on consent (updates, discounts, promotions, etc.) is mainly carried out by sending newsletters that will be delivered to the email address you provided during the registration of the service.
5 – Personal data requested, nature of provision and possible consequences of refusal. All personal data collected in this processing, except those whose legal basis is attributable to consent, are strictly necessary for the conclusion of the contract and the management of related obligations. Therefore, refusal to provide such data makes it impossible to proceed with free registration on the website www.artfinancefund.com or to purchase the related subscription services. As regards the processing of personal data that requires explicit consent, refusal to provide such data does not prevent the conclusion of the contract. However, refusal will preclude you from taking advantage of the benefits reserved for users who have consented to the processing of data for the purposes referred to in points “a” and “b” of the section “purpose of processing”.
6 – Persons authorized to process your data – Communication and dissemination of data. The personal data collected are processed by company staff, appointed by Art Finance Fund, who need to know them in the performance of their activities. Such data may also be processed by natural and/or legal persons external to the company organization (consultants, professionals, etc.), for the performance of technical support activities as well as for the resolution of malfunctions and/or failures of Art Finance Fund's information systems.
7 – Transfer of personal data. Your data will not be transferred either to Member States of the European Union or to third countries outside the European Union.
8 – Existence of automated decision-making, including profiling. The Controller does not adopt any automated decision-making process, including profiling, as referred to in Article 22, paragraphs 1 and 4, of EU Regulation No. 679/2016.
9 – Rights of the data subject. At any time, you may exercise, pursuant to Articles 15 to 22 of EU Regulation No. 2016/679, the right to: a) request confirmation of the existence or otherwise of your personal data; b) obtain information about the purposes of the processing, the categories of personal data, the recipients or categories of recipients to whom the personal data have been or will be communicated and, where possible, the retention period; c) obtain rectification and erasure of data; d) obtain restriction of processing; e) obtain the portability of personal data, i.e. receive them from a data controller, in a structured, commonly used and machine-readable format, and transmit them to another data controller without hindrance, if technically feasible; f) object to processing at any time, including in the case of processing for direct marketing purposes;
g) object to automated decision-making relating to natural persons, including profiling; h) request from the data controller access to personal data and rectification or erasure of such data or restriction of processing concerning you or to object to their processing, as well as the right to data portability; i) withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal; j) lodge a complaint with a supervisory authority.

10 – Final information. This privacy notice is available in Italian, English, French, and Spanish. However, it should be noted that, in the event of discrepancies, interpretative difficulties, or problems of any other kind, only the notice written in Italian shall be considered legally binding.
